    Benefits Available for Undocumented Workers
    Undocumented worker was awarded medical, surgical, and hospital benefits and temporary compensation from the date of his injury through the date he was found to be medically stationary. Gamez v. Indus. Comm'n of Arizona, 141 P.3d 794, 795 (Ariz. Ct. App. 2006). He was denied further benefits because they were deemed medically unnecessary. Id., 141 P.3d at 796.

    A strongly argued concurrence in Gamez v. Indus. Comm'n of Arizona insisted that undocumented workers were not employees as defined by the Workers' Compensation Act, despite the fact that the definition of "employee" includes "aliens and minors legally or illegally permitted to work for hire." 141 P.3d 794, 796-805 (Ariz. Ct. App. 2006).
